THE COWBOY CLASSIC HORSE SALE – TERMS & CONDITIONS OF BIDDING

By registering to bid in The Cowboy Classic Horse Sale, you agree to the following Terms and Conditions. Please read them carefully before participating.
1. ELIGIBILITY

All bidders must be at least 18 years of age and legally able to enter into binding contracts.

Registration must be completed and approved prior to bidding.

Bidders must provide accurate and complete information during registration. The sale host reserves the right to refuse or revoke registration at any time.
2. BIDDING RULES
-
All bids are final and legally binding. Once a bid is placed, it cannot be retracted.

The highest bidder at the close of bidding will be deemed the buyer.

The seller reserves the right to:
• Set or reject reserve prices
• Withdraw any horse from the sale at any time
• Refuse any bid
3. PAYMENT
-
Full payment is required within 3 business days of the sale’s conclusion.

Accepted payment methods include:
• Wire Transfer
• Cashier’s Check
• Personal Check (horse will not be released until the check clears)
• Credit Card (3.5 % processing fee)

No horse will be released or ownership transferred until payment is received in full and cleared.
4. POST-SALE RESPONSIBILITY & PICKUP

Upon conclusion of the sale, the buyer assumes all risk and responsibility for the horse, including injury, illness, or death.

Buyers must arrange pickup or transportation within 10 days of the sale ending.

Horses not picked up within that time may be subject to daily boarding and care fees unless prior arrangements are made.
5. HORSE DESCRIPTIONS, SOUNDNESS & WARRANTIES

All horses are sold as-is, where-is, with no guarantees unless specifically stated by the seller.

Descriptions, pedigrees, and health details are provided in good faith but are not guaranteed.

Pre-purchase veterinary exams are encouraged and must be scheduled prior to the close of bidding at the buyer’s expense.
6. NO REFUNDS OR RETURNS
7. LIABILITY

The seller, auction host, and associated parties are not liable for any accidents, injuries, or losses that occur during the sale, transport, or transfer of ownership.

Bidders and buyers participate in this sale at their own risk.
8. DISPUTE RESOLUTION
-
Any disputes will be governed by the laws of the State of Utah.

Venue for legal matters will be Beaver County, Utah.
9. PRIVACY & COMMUNICATION

By registering, you consent to receive sale-related communications via email, phone, or text.

Your information will only be used for the purpose of this sale and will not be sold or shared without your consent.
10. ACCEPTANCE
By registering and placing bids in The Cowboy Classic Horse Sale, you confirm that you have read, understood, and agree to these Terms and Conditions.
